NSF CHECKS

Many businesses that accept checks have had to deal with checks that’ve been returned with the dreaded Not Sufficient Funds or NSF stamped across a check.  The first step is to try to contact the payor of the check and get the payor to make good on the funds, unfortunately, all to often the payor of the check can’t be located.  The business, or payee, is then left with the prospect of trying to collect on the bad check by going to court.  The first problem after filing the lawsuit is how to serve the payor.  That’s where Assured Serve makes the process simple and FREE to the business beginning right at the point of sale.

POINT OF SALE

At the point of sale when the check is tendered, the check is stamped with an agreement that designates Assured Serve as the Payor’s Authorized Agent for Service of Process for all legal matters related to the check. The payor then signs the agreement designating Assured Serve as the Payor’s Authorized Agent for Service of Process.  Once the agreement is signed, the payor becomes responsible for keeping Assured Serve apprised of the payor’s current contact information so that any legal documents can be properly forwarded to the payor.

In the event the check is returned NSF, the business does not have to waste time and money attempting to track down the payor, the business simply and for FREE, serves Assured Serve, via email, with any legal documents that need to be forwarded to the payor.  The business then moves forward with their lawsuit.

The payor will find it very difficult to successfully claim they weren’t served with the lawsuit because Assured Serve will provide verification that the lawsuit was properly served upon Assured Serve as the Payor’s Authorized Agent for Service of Process.

CONTRACTS

A contract is drafted and entered into, then, the other party fails to comply with the terms and conditions of the contract and you’re forced to file a lawsuit.  But before the lawsuit can move forward the other party needs to be served and you can’t find them to serve them.  That situation can prove costly and time consuming, unless you used Assured Serve.  And just remember, there is no charge to you to use Assured Serve.  Yes, that’s right, it’s Free!!!!

DRAFTING THE CONTRACT

At the time the contract is drafted a paragraph is inserted into the contract designating Assured Serve as the Authorized Agent for Service of Process for all legal matters related to the contract.  The other party then signs the contract designating Assured Serve as their Authorized Agent for Service of Process.

In the event a lawsuit is filed, regarding the contract, you simply and for Free, email Assured Serve the legal documents and service is complete.
